DMCA Policy

At FreshUpReviews (“the Website,” “we,” “our,” or “us”), we respect the intellectual property rights of others and expect our users to do the same. I’m Camilla Peterson, founder and health researcher at FreshUpReviews, and I’m committed to maintaining a website that honors copyright law. This DMCA Policy outlines how we handle claims of copyright infringement in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) and what you should do if you believe your copyrighted work has been used on our site without authorization.


1. Our Commitment to Copyright Compliance

All content published on FreshUpReviews—including written articles, review summaries, graphics, and logos—is either original, licensed, or used under principles of fair use. I take copyright violations seriously. If you are a copyright owner (or authorized to act on their behalf) and you believe that material on this Website infringes your copyright, please follow the procedure below. We will promptly investigate and, if necessary, remove or disable access to the infringing material.


2. Filing a DMCA Takedown Notice

To submit a valid DMCA notification, please send a written communication to our Designated Copyright Agent (details below) that includes all of the following information:

  1. Your Contact Information: Full legal name, physical address, telephone number, and a valid email address.
  2. Identification of the Copyrighted Work: A clear description of the copyrighted work claimed to have been infringed. If multiple works are covered by a single notice, you may provide a representative list.
  3. Identification of the Infringing Material: The specific URL(s) or other precise location(s) on https://freshupreviews.com where the allegedly infringing material appears. General references like “your blog page” are insufficient—please provide direct links.
  4. A Statement of Good Faith: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A Statement of Accuracy: A statement that the information in your notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  6. Physical or Electronic Signature: The notice must be signed by the copyright owner or their authorized agent. A typed name at the bottom of an email qualifies as an electronic signature.

4. Upon Receiving a Valid DMCA Notice

When we receive a proper and complete DMCA takedown notice, we will:

  • Promptly review the notice and the identified material.
  • Remove or disable access to the allegedly infringing content.
  • Make a reasonable attempt to notify the user who posted the content (if applicable) that we have removed or disabled it.
  • Provide the user with a copy of the DMCA notice and instructions on how to file a counter-notification, if they believe the removal was in error.

5. Filing a Counter-Notification

If you believe that material you posted on FreshUpReviews was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

  1. Your name, address, telephone number, and email address.
  2. Identification of the material that was removed and the URL where it previously appeared.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled due to mistake or misidentification.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which FreshUpReviews may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent.
  5. Your physical or electronic signature.

Send the counter-notification to the same Designated Copyright Agent at dmca@freshupreviews.com. Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If they do not file a court action to restrain you from the allegedly infringing activity within 10 business days, we may restore the removed material.


6. Repeat Infringers

In accordance with the DMCA and other applicable laws, FreshUpReviews maintains a policy to terminate, in appropriate circumstances, users who are repeat infringers of intellectual property rights.


7. Important Notes & Limitations

  • Legal Advice: This DMCA Policy is for informational purposes only and does not constitute legal advice. If you are unsure about your rights or obligations, consult an attorney before filing a notice or counter-notification.
  • Misrepresentation Penalties: Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing—or that material was removed by mistake—may be liable for damages, including costs and attorneys’ fees.

8. Changes to This DMCA Policy

We may update this DMCA Policy to reflect changes in law or our operational practices. When we do, the “Last Updated” date will be revised. Please review this page periodically.
